**General Terms and Conditions (GTC) for the Rental of a Holiday Apartment** --- ### 1. Scope These General Terms and Conditions apply to the rental of the 50 m² apartment in the center of Mondsee (multi-family building) by the landlord to the guest. They apply to bookings made via booking platforms as well as direct bookings. --- ### 2. Conclusion of Contract An accommodation contract is concluded as soon as the booking is made by the guest and confirmed by the landlord. For bookings made via platforms, the respective platform terms and conditions also apply. --- ### 3. Prices and Payment Terms The prices quoted are per stay or per night as per the booking confirmation. The payment terms are governed by the respective booking platform or the individual agreement for direct bookings. Any additional costs (e.g., local tax) will be shown separately. --- ### 4. Cancellation Policy For bookings made via platforms, only the cancellation policies stated there apply. For direct bookings, the cancellation policies are agreed upon individually and recorded in the booking confirmation. --- ### 5. Arrival and Departure * Check-in: from the agreed time * Check-out: until the agreed time. The exact times will be communicated to the guest before arrival. A late departure fee may be charged. --- ### 6. Use of the Accommodation * The accommodation may only be used by the agreed number of people. * The apartment is an **adults-only property** – children are not permitted. * Pets are not allowed. * Smoking is not permitted anywhere in the accommodation. * Parties and events are prohibited. The guest agrees to treat the accommodation and its contents with care. --- ### 7. Amenities The apartment is rented to a high/luxury standard. However, the landlord assumes no liability for the guest's subjective expectations regarding furnishings or design. --- ### 8. Liability The guest is liable for all damage to the accommodation or its contents caused by them or their travel companions. The landlord is only liable for damage resulting from intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law. No liability is assumed for the guest's valuables. --- ### 9. Cancellation by the Landlord The landlord is entitled to cancel the contract for important reasons, in particular in the event of: * force majeure * unforeseeable damage to the accommodation * breach of contract by the guest. Payments already made will be refunded in this case. --- ### 10. House Rules The guest is obligated to comply with the house rules posted in the apartment and the rules of the multi-family building, especially regarding quiet hours. --- ### 11. Data Protection The data collected during the booking process will be used exclusively for processing the rental agreement and will not be passed on to third parties unless there is a legal obligation to do so. --- ### 12. Jurisdiction and Applicable Law Austrian law applies. The place of jurisdiction is – to the extent permitted by law – the competent court at the landlord's place of business. --- ### 13. Final Provisions Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. --- **Status:** [April 2024]
